Professional Standards
As professionals, we, the members of Bulgarian Web Association, are concerned about constant elaboration of Web business in Bulgaria and its competitiveness with European practices. Therefore, we brought out these professional standards, which will guide us in our work. Our experience and observations upon Bulgarian and International Web business had convinced us in the necessity to observe the following professional standards:
І. Quality of services
From all BWA members is required and expected to keep up high quality services. This high quality should be result from technical competence, company politics, and constant feedback with clients, competitors and public.
Technical competence means accumulation of professional knowledge and practices. BWA members should provide their personnel with information, quality trainings and possibilities for raising their professional qualification.
ІІ. Transparency of work
From all BWA members is required and expected transparency in working with clients, competitors and public. This means:
- Escape conflict of interests (within the company, with other people, financial etc.)
- Show professional competence of company business and the whole of Web business.
- Secure transparency of work upon a certain project – to place at client’s disposal a detailed working plan of the project, financial part, rights and obligations. This does not include spreading confidential information about the project, unless it is legitimately required.
ІІІ. Equitable and reasonable rates
BWA members determine and declare in public equitable and reasonable rates for their work, which correspond to offered services and market reality and tendency.
The rates are determined on the following bases:
(a) Time and effort spent on the project,
(b) Stage of difficulty of the project,
(c) Ordinary market rates – advisable price for Bulgarian projects is 20 EUR/per hour/per person;
(d) Invested resources and achieved result,
(e) Terms determined by the guarantee,
(f) Relations between the company and the concrete client,
(g) Experience, reputation and company potential,
(h) Fixed or conditional is the rate service,
(i) Bilateral agreement between the company and the concrete client,
(j) Rates should be based on reasonable and real conditions.
ІV. Confidential information
BWA members keep in full confidentiality the secret information about business plans, personal life etc., committed to them by the clients. They do not use this secret information for personal or company benefit; do not commit it to third party unless it is legitimately required.
Manifestation of loyalty towards the client also requires evasion of engagement with third parties, who eventually could take advantage with the confidential information. This loyal attitude should be preserved after breaking off the business relations.
While collecting personal data, BWA members should abide the Bulgarian Law for Protection of Personal Data. They should collect personal data only for reasonable purpose and require not more than necessary. Disclosing personal data should be done only after agreement with their possessor or in case of specific circumstances.
V. Advertisement
BWA members only public and/or produce communication materials that are conformable to the requirements of Bulgarian legislation and recommendations of International Code for loyal advertisement practices.
BWA members do not use for their own or for their clients’ marketing, promotional or personal aims initiatives, based on UCC principles (Unsolicited Commercial Communication) – SPAM. The definitions of SPAM are written in EU directive «Privacy and Electronic Communications Directive (2002/58/EC) » and in the Law for Protection of Personal Information of Republic of Bulgaria.
BWA members do not allow in their communication inadmissible practices that corrupt image and good name of other companies. Comparative advertisement is allowed only in cases of comparable, measurable and provable elements.
BWA members do not lead in misbelieve their clients, partners or public by using mislead information while stipulating the advertisement conditions. BWA members should abide by marketing information sources that are clear, veracious, easy to be proven and systematic. BWA members are not allowed to use statistic researches that are not up to standard.
BWA members should not use methods for unwitting traffic direction. While rendering an account of visit traffic, they should not take into consideration the traffic, generated by robots of searching machines or directories, as well as internal company traffic.
VІ. Law of business
BWA members should hold all the necessary licenses, legal and certified software.
In their work, BWA members should use their own creative, photo materials, graphics and texts, or such with guaranteed authorship rights. They are not allowed to borrow software or graphical solutions from nobody. They work within the law requirements and restrictions.
BWA members advise their clients to abide authorship rights when using legal information in their web sites.
BWA members do not send SPAM; do not publish on Web sites pornographic or offensive materials and advise their clients to work the same way.
BWA members ought to keep contract agreements with clients and within their own company. The employers should attend contract clauses with employees and clients to be always immaculate; company documents (financial and others) should be kept strictly; contracts with clients should be signed according to all legislation requirements and performed correctly. BWA members are encouraged to work in accordance with law regulations, concerning working hours, hygiene and climate.
While signing a contract, BWA members ought to approach with no discrimination.
BWA members should be loyal towards their clients and employees even when business relations are over. All information acquired during their joint work stays confidential unless it is legitimately required.
In respect with personnel policy, BWA members ought to respect their competitors. Illegitimate information exchange or offensive attitude towards other companies in Web or other business is not tolerated.
VІІ. Social awareness
BWA members should manage their business applying and abiding generally accepted moral and law standards.
BWA members take social responsibility for Bulgarian Web content and work for improving its quality and volume. BWA undertakes actions for teaching the public and revealing the positive aspects of Web for business and society.
BWA members are ready to co operate different institutions, Bulgarian government, businesses etc. in respect of Bulgarian Web content and its regulation.
